The AFSS is due annually on whatever anniversary date your council set when the original fire safety schedule was issued. Most owners assume there’s a universal NSW deadline. There isn’t. Yours could fall in March, yours could fall in October. The statement covers the twelve months leading up to that date.
Who is legally responsible for AFSS lodgement: owner, strata, or tenant?
Legally, the building owner. The EP&A Regulation 2021 puts the obligation there and nowhere else. Strata managers handle most of the coordination in practice, especially for residential and mixed-use stock. Tenants sometimes get pulled in via lease terms. The lodgement itself and the penalty for missing it, sit with whoever owns the title.
What is a Competent Fire Safety Practitioner, and do I need one?
For most commercial buildings, yes. The AFSS itself has to be endorsed by someone holding FPAS accreditation, which is the scheme NSW recognises for fire safety certification. That’s separate from being a qualified fire safety technician. Both roles exist in our work, but only one signature carries the statement through the council.
How much does commercial fire safety certification cost in Sydney?
